Obscurix Shop Affiliate Terms of Use

These Affiliate Terms of Use (“Terms”) govern participation in the Obscurix Shop Affiliate Program (“Program”). By enrolling, you (“Affiliate”) agree to comply with these Terms as well as the Obscurix Shop Terms of Service and Privacy Policy.

1. Enrollment & Approval

– Affiliates must submit accurate information during registration.
– Obscurix LLC reserves the right to approve or reject applications at its sole discretion, including for sites or content deemed offensive, unlawful, or inconsistent with Obscurix’s brand values.
– The Program is open only to U.S.-based affiliates.

2. Affiliate Responsibilities

– You may promote Obscurix Shop products using provided links, banners, or materials.
– You are responsible for compliance with all applicable laws, including FTC endorsement guidelines. Disclosures of affiliate relationships must be clear and conspicuous.
– You may not:
  – Misrepresent Obscurix products or make false claims.
  – Engage in spamming, coupon poaching, or misleading redirects.
  – Use paid ads that bid on Obscurix trademarks or impersonate Obscurix.
  – Promote through offensive, hateful, adult, or illegal content.

3. Commissions & Payment

– Affiliates earn a 15% commission on net sales generated through valid referral links unless otherwise agreed upon in writing.
– Net sales exclude shipping, taxes, discounts, chargebacks, and refunds.
– Payments are issued via direct deposit after a 37-day holding period to account for fraud prevention and product returns.
– There is no minimum payout threshold. Payments are released regardless of amount, subject only to any applicable payout processing fees charged by the payment provider.
– Affiliates are responsible for all taxes on their earnings.
– A valid W-9 is required once an Affiliate’s annual payouts equal or exceed $600 in a calendar year, per IRS regulations.

4. Termination

– Either party may terminate participation at any time, with or without cause.
– Obscurix may withhold unpaid commissions if fraud, violation of these Terms, or chargebacks occur.

5. Intellectual Property

– Affiliates may use Obscurix trademarks, product images, and materials solely for Program purposes. Unauthorized modification or misuse is prohibited.

6. Liability & Indemnification

– Participation is at your own risk. Obscurix LLC makes no guarantees of earnings.
– Affiliates agree to indemnify and hold harmless Obscurix LLC from any claims, damages, or expenses arising from participation in the Program.

7. Modification of Terms

– Obscurix LLC may update these Terms at any time. Continued participation after changes constitutes acceptance of the new Terms.
